Terms of Use

Chapter 1 General

 

Article 1 (Purpose)
The purpose of these terms and conditions is to prescribe basic matters concerning the conditions and procedures for using Internet services provided by Swan Think (hereinafter referred to as “site”).



Article 2 (Effect and Change of Terms and Conditions)
① These terms and conditions are effective by notifying the customer through the service screen or other means.
② The Site may change the contents of these Terms and Conditions, and the changed Terms and Conditions shall become effective by announcing or notifying in the same manner as in paragraph 1.



Article 3 (Definition of Terminology)
The terms used in these Terms and Conditions are defined as follows.
① Member: It refers to an individual or organization that has signed a service use contract with the site or has been assigned a user ID.
② Applicant: It refers to an individual or organization that applies for membership.
③ ID: It refers to the combination of letters and numbers determined by the member and approved by the site for the identification of the member and the use of the service.
④ Password: It refers to the combination of letters and numbers determined by the member to confirm that the member is a member that matches the ID given and to protect the member’s own secret.
⑤ Cancellation: refers to the cancellation of a service contract by a site or member.



Chapter 2 Service Use Agreement



Article 4 (Establishment of Use Contract)
① If you click the Accept button at the bottom of the Terms and Conditions, you are considered to accept these Terms and Conditions.
② The use contract is established by the site accepting the application for use after agreeing to the terms and conditions of use of the service.



Article 5 (Application for Use)
① In order for an applicant to use this service, he/she must record and submit the user information required by the site’s prescribed subscription application form.
② All user information on the application form is considered to be real data. Users who do not enter their real names or physical information are not legally protected and may be subject to service restrictions.



Article 6 (Acceptance of Application for Use)
① The site accepts the applicant’s application for service use with the exception of paragraphs (2) and (3).
② The site may withhold consent until the reasons for restriction on consent to the application are resolved in the following cases.
A. If there is no room for service-related facilities
I. In case of technical difficulties
All. If other sites are deemed necessary
③ The site may refuse consent if the applicant.
A. Where an application is made using the name of another individual (site)
I. Where an application is made by falsely stating user information
All. Where an application is filed for the purpose of hindering the well-being order of society or the good customs and customs of society
La. Where the requirements for application for use prescribed on the site are not satisfied



Article 7 (Change of User Information)
If the member information entered at the time of application for use is changed, the member shall revise it online, and the member shall be responsible for all problems caused by not changing it.



Chapter 3 Obligations of Contracting Parties



Article 8 (Duty of Site)
① The site provides members with the following services.
A. Sending newsletters about new services and domain information
I. Automatically enter personal information when registering additional domains
All. Additional services for domain registration and management
② The site shall not divulge, disclose or distribute the personal information of the member acquired in connection with the provision of the service to others without the consent of the member, and shall not be used for commercial purposes other than service-related affairs. However, exceptions are made in cases falling under any of the following subparagraphs.
A. Where a request is made by a state agency pursuant to the provisions of the Act on the Framework Act on Telecommunications, etc
I. Where there is an investigative purpose for a crime or at the request of the Information and Communication Ethics Committee
All. Where there is a request according to the procedures prescribed by other relevant laws and regulations
③ The Site is obligated to provide services continuously and reliably as set forth in these Terms and Conditions.



Article 9 (Duty of Members)
① A member shall not perform any of the following acts when using the service.
A. Illegal use of another member’s ID
I. The act of reproducing information obtained from services for purposes other than the use of members without prior approval of the site, or using it for modification, publication, broadcasting, etc., or providing it to others
All. Infringement of other rights, such as copyright on the site, copyright of others, etc
La. The act of disseminating information, sentences, figures, etc. that violates public order and customs
bad luck. an act that is objectively judged to be associated with a crime
Bar. Other acts in violation of relevant laws and regulations
② Members shall comply with the relevant laws and regulations, matters prescribed in these terms and conditions, guidance on service use, and precautions.
③ Members shall comply with the usage restrictions posted or separately announced by the site in the service notice for each content.



Chapter 4 Service Delivery and Use



Article 10 (Member’s obligation to manage member ID and password)
① The member is responsible for all management of the ID and password. The member is fully responsible for all consequences caused by the negligence of the management of the ID and password given to the member and the illegal use.
② If your ID is used illegally or for other security violations, the member must notify the site.



Article 11 (Restriction and Suspension of Service)
① The site may restrict or suspend all or part of its services in the event of exhibition, catastrophe, natural disaster, or possible national emergency, or other compelling reasons such as termination of telecommunications services by key operators under the Telecommunications Business Act.
② When a site restricts or suspends the use of services pursuant to paragraph (1), it shall notify the member of the grounds, period of restriction, etc. without delay.



Chapter 5 Changes to and Cancellations of Contracts



Article 12 (Change of Information)
If a member wants to change customer information such as address and password, he/she can change it using the member information change service on the website.



Article 13 (Termination of contract matters)

A member may terminate a service use contract, and if he/she cancels it, he/she shall apply for termination on the site through the service himself/herself or by phone or online. The site restricts the members from using the service from the day the application for termination is received. If a member intends to terminate a contract of use falling under any of the following paragraphs, the site shall notify the customer of the intention and give him/her an opportunity to explain it by not later than seven days before the cancellation action.
① Where a customer violates the regulations on restriction of use or does not resolve the reasons for restriction within the period of restriction of use
② Where the Information and Communication Ethics Committee requests termination of use
③ Where a customer fails to respond to a statement of opinion without justifiable grounds
④ Where an application has been made in the name of another person, or where a contract for use has been concluded by attaching a false entry or false document of the application
The site may restrict the subscription of customers who have been terminated under the above regulations for a period separately determined.



Chapter 6 Compensation for Damages

 

Article 14 (Exemption Clause)
① The site is exempt from liability for damages caused by the member’s failure to obtain the expected benefit from the provision of the service or the selection or use of the service data.
② The site is exempted from liability in the event of a service failure or damage to the member’s data due to reasons attributable to the member or intention of a third party.
③ The site is exempt from responsibility for the contents of materials posted or transmitted by members.
④ In the case of a trademarked domain, the purchasing member party shall be liable for any damages or compensation that may result from this, and the site shall not be held responsible for this.



Article 15 (Jurisdictional Court)

In the event of a dispute between the site and its members regarding the service, the court having jurisdiction over the location of the site’s headquarters shall be the competent court.
